Are the Extra ObamaCare Subsidies Coming Back in 2027? October 2026 Update
Updated October 12, 2026 · By the Arte Insurance team · 4-minute read
Short answer: not for now. The larger ObamaCare tax credits that started in 2021 expired on December 31, 2025. As of October 12, 2026, Congress has not passed an extension, so 2027 coverage follows the rules that are law today. Here’s where things stand and how to plan.
What happened to the extra subsidies
From 2021 through 2025, temporary federal laws made premium tax credits bigger and removed the income cap, so people above 400% of the poverty level could also get help. Those changes ended on December 31, 2025.
- December 11, 2025: a Senate bill to extend them for three years fell short of the 60 votes needed to move forward (51–48).
- January 2026: the House passed a three-year extension, 230–196.
- Since then: the Senate has not voted on the House bill. A bipartisan group of senators has reportedly discussed a compromise, but no vote had been scheduled as of early October 2026.
Insurers set their 2027 prices assuming the extra help stays expired.
The rules for 2027 (current law)
| Rule | 2027 |
|---|---|
| Who can get a premium tax credit | Household income from 100% to 400% of the poverty level |
| Income range, 1 person | $15,960 – $63,840 |
| Income range, family of 4 | $33,000 – $132,000 |
| Most you’re expected to pay for the benchmark Silver plan | 2.15% to 10.22% of income, depending on income |
| Above 400% of the poverty level | No premium tax credit |
| Extra savings on deductibles and copays | 100% – 250% of the poverty level, with a Silver plan |
From January 1, 2027, immigration status also matters: the credits are limited to U.S. citizens, green card holders, Cuban/Haitian entrants and COFA migrants. See who qualifies.
What if Congress acts later?
If a new law passes, the details (which years, which incomes, when it starts) would depend on what Congress writes, and the Marketplace would need time to put it in place. We’ll update this article and contact our clients if anything changes.
Don’t wait for Congress to enroll. December 15, 2026 is still the deadline for coverage that starts January 1.
What you can do now
- See your 2027 number with our free 2027 ObamaCare calculator. It shows the most you’d be expected to pay for the benchmark Silver plan.
- Estimate your income carefully. Starting with the 2026 tax year, there’s no limit on how much extra credit you may have to pay back at tax time if your income ends up higher than you estimated.
- Compare all metal levels. If your income is between 100% and 250% of the poverty level, a Silver plan may come with lower deductibles and copays.
- If you’re above 400%, compare the lowest-cost plans carefully, and talk to us about your options.
- Enroll by December 15 for coverage on January 1.
